Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of BrowseIdaho at https://browseidaho.com and related communications (email/SMS). By using BrowseIdaho, creating an account, or opting into messages, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the service.

2. Who we are

BrowseIdaho is a consumer home-search website at https://browseidaho.com. We display listing information and tools to browse, save, and get updates.

BrowseIdaho is not a separately licensed brokerage. Licensed real estate brokerage services offered through this site are provided by Silvercreek Realty Group, an Idaho-licensed brokerage.

Requesting a "local expert," tour, or callback may connect you with a licensed professional affiliated with Silvercreek Realty Group or another licensed broker as assigned.

3. Eligibility

You must be able to form a binding contract under applicable law. The service is intended for users in the United States, with a focus on Idaho real estate search.

4. Accounts

You agree to provide accurate information and keep credentials confidential. You are responsible for activity under your account. Notify us of unauthorized use at [email protected].

We may suspend or terminate accounts for violation of these Terms, fraud risk, MLS/IDX noncompliance, or abuse.

5. License to use the site

We grant you a limited, non-exclusive, non-transferable, revocable license to access BrowseIdaho for personal, non-commercial home-search use, subject to these Terms and MLS/IDX rules.

You may not:

• Scrape, harvest, bulk-download, or misuse listing data
• Circumvent access controls, soft gates, or rate limits
• Reverse engineer or disrupt the service
• Use the service to spam, harass, or violate law
• Misrepresent your identity or affiliation
• Use listing content except as allowed by MLS/IDX and on-screen notices

6. Listings, IDX, and accuracy

Listing data is provided by third parties (including MLS / IDX feeds and related listing systems). We do not guarantee accuracy, completeness, or availability of any listing. Properties may be sold, withdrawn, or change price/status without notice.

Always verify information with a licensed professional and official sources before making decisions.

7. Communications (email & SMS)

If you opt in, you agree to receive communications as described in our Privacy Policy, including:

• Marketing email (CRM / lead processor) and/or listing email (listing / IDX / alert provider alerts)
• Marketing SMS (CRM / lead processor) and/or listing SMS (listing / IDX / alert provider alerts)

SMS program summary (10DLC)

• Brand display name: BrowseIdaho
• Program: BrowseIdaho home-search alerts and optional marketing texts
• Message frequency varies; message & data rates may apply
• Text STOP to cancel; HELP for help
• Consent is not a condition of purchase or of browsing

Registration uses (1) communications/email consent and (2) separate SMS consent (default off). Granular toggles are available in account settings.

8. Soft gates and lead features

Some features (saving searches, favorites sync, full photo galleries, tour/ask forms) may ask for contact information and consents. You may dismiss non-mandatory soft gates and continue browsing core listing facts as the product allows.

9. Intellectual property

BrowseIdaho branding (including the Dual-Tone wordmark and diamond mark), site design, and software are owned by us or our licensors. Listing photos and content remain subject to MLS and listing-broker rights.

You may not use our marks without permission, except for legitimate referencing of the public site.

10. Third-party services

The service relies on service providers such as CRM / lead processors, listing / IDX / alert providers, SMS/email delivery providers, and hosting / analytics providers. Their terms and policies may also apply to their processing. We are not responsible for third-party outages beyond our reasonable control.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. REAL ESTATE DECISIONS INVOLVE RISK; BROWSEIDAHO IS NOT A SUBSTITUTE FOR LICENSED ADVICE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BROWSEIDAHO AND SILVERCREEK REALTY GROUP, AND THEIR AFFILIATES, SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100, EXCEPT WHERE PROHIBITED.

13. Indemnity

You agree to indemnify and hold harmless BrowseIdaho and its operators from claims arising out of your misuse of the service, your content, or your violation of these Terms or law.

14. Governing law

These Terms are governed by the laws of the State of Idaho, excluding conflict-of-law rules.

15. Changes

We may update these Terms by posting a revised version. Continued use after changes become effective constitutes acceptance, except where law requires otherwise.
